These Terms of Use (hereinafter referred to as the "Terms of Use") This Terms of Use Agreement (hereinafter referred to as the "Agreement") applies to the services provided by nekochans (hereinafter referred to as the "Management Team") (hereinafter referred to as the "Management Team") provides on this website (hereinafter referred to as the "Service"). The "Terms and Conditions of Use" (the "Terms and Conditions") set forth the terms and conditions of use of the services provided by nekochans (the "Management Team") on this website (the "Services"). The terms and conditions for the use of the Service are set forth below. Users (hereinafter referred to as "Users") are required to agree to all of the terms and conditions of this Agreement when using the Service. By using the Service, you are deemed to have understood and agreed to all of the terms and conditions of this Agreement.

Article 1 (Application)

These Terms of Use shall apply to all relationships related to the use of the Service between the user and the Management Team. The privacy policy posted by the Management Team on the Website shall constitute a part of these Terms.

Article 2 (Registration for Use)

Registration for use shall be completed when the applicant applies for registration for use in accordance with the method prescribed by the Management Team and when the Management Team approves the application. The Operator may not approve the application for registration if it determines that the applicant has any of the following reasons, and shall not be obliged to disclose any reasons for such denial.

1. The applicant has provided false information when applying for registration.
2. If the application is from a person who has violated these Terms of Use.
3. the application is from a person who is an antisocial force, etc. (meaning a crime syndicate, a member of a crime syndicate, a right-wing organization, an antisocial force, or any other person equivalent thereto) 1. if the Operator Team determines that the applicant is an anti-social force, etc. (which means a crime syndicate, organized crime syndicate, right-wing group, anti-social force, or other equivalent), or is involved in any interaction or involvement with anti-social forces, such as cooperation or involvement in the maintenance, operation or management of anti-social forces, etc. through funding or otherwise.

Article 3 (Management of Account Registration)

User shall be responsible for registering, changing, and managing the information registered on the Site when using the Service, including GitHub account. If you use the Services through your GitHub account, you are deemed to have used the Services by the user who owns that GitHub account. You are responsible for any damages caused by unauthorized use of your GitHub account, and the Management Team will not be held liable for any such damages.

Article 4 (Authorization for GitHub OAuth Apps)

The Operator requests the User to authorize the Service to reference GitHub information as a means of obtaining information to log in to the Service and as a means of obtaining an access token for the User's GitHub account. The service obtains permission from the user to read the GitHub account information. The Service will not use the information for any other purpose or disclose it to any third party.

Article 5 (Withdrawal from membership)

A user may withdraw from the Service and delete his/her registration as a user by notifying the Operation Team in a manner determined by the Operation Team.

Article 6 (Prohibited Matters)

In using the Service, a user shall not engage in any of the following acts.

1. Acts that violate laws, ordinances, or public order and morals.
2. Actions related to criminal acts.
3. Acts that destroy or interfere with the functions of the Management Team's server or network.
4. Acts that may interfere with the operation of the Management Team's services.
5. acts of collecting or accumulating personal information about other users.
6. acts of impersonating another user.
7. acts of providing benefits directly or indirectly to antisocial forces in relation to the services of the Management Team.
8. Any other acts that the Management Team deems inappropriate.

Article 7 (Suspension of the Service, etc.)

The Management Team may suspend or discontinue the Service, in whole or in part, without prior notice to the user, for any of the following reasons.

1. When maintenance, inspection, or updating of computer systems related to the Service is performed.
2. When provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters.
3. When computers or communication lines are stopped due to an accident.
4. In any other cases in which the provision of the Service is deemed difficult by the Management Team.

The Management Team shall not be liable for any disadvantage or damage incurred by the user or a third party due to the suspension or interruption of the provision of the Service, regardless of the reason.

Article 8 (Copyright)

The user shall represent and warrant to the Management Team that the user has the legal right to post or transmit the posted data, and that the posted data does not infringe the rights of any third party. The copyrights of the data posted by users using the Service shall be reserved to the users concerned and other existing right holders. However, the Management Team may use text, images, videos, etc. posted or edited using the Service, and users shall not exercise their moral rights with regard to such use. Except as stipulated in the main text of the preceding paragraph, all copyrights and other intellectual property rights to the Service and all information related to the Service shall belong to the Management Team or to the right holders who have authorized the Management Team to use them. The User shall not reproduce, transfer, lend, translate, modify, reprint, publicly transmit (including making transmittable), transmit, distribute, publish, or use for business purposes.

Article 9 (Restriction of Use and Cancellation of Registration)

The Management Team may, without prior notice, restrict a user's use of all or part of the Service or terminate the user's registration as a user in the following cases.

1. in case of violation of any of the provisions of these Terms of Use.
2. if any false fact is found in the registration information.
3. if the user has not used the Service for a period of one (1) year or more.
4. if it is found that the user has uploaded content that violates public order and morals. (deletion of the subject content)
5. if it is found that the user has uploaded content that violates copyright. (the subject content will be deleted)
6. in any other cases where the Operator deems the use of the Service to be inappropriate.

The Operator shall not be liable for any damages incurred by users as a result of actions taken by the Operator in accordance with this Article.

Article 10 (Provision by Third Parties)

The Service may provide links to other websites or resources. These sites and resources are managed by their respective operators, and the management team assumes no responsibility or liability for them.

Article 11 (Disclaimer)

The Management Team makes no warranty that the Service will meet the user's specific objectives, have the expected functions, commercial value, accuracy, or usefulness, that the user's use of the Service will comply with applicable laws, regulations, or internal rules of industry associations, or that defects will not occur. The Management Team makes no warranty of any kind with respect to the value, accuracy, or usefulness of the Service. The Management Team shall not be liable for any damages incurred by users as a result of the Service. The Management Team shall not be liable for any transactions, communications, disputes, etc. arising between a user and another user or a third party in connection with the Service.

Article 12 (Change of Service Contents, etc.)

The Management Team may change the contents of the Service or discontinue providing the Service without notice to the User, and shall not be liable for any damages incurred by the User as a result thereof.

Article 13 (Handling of User Information)

The handling of user information by the Operator shall be governed by the separate Operator Privacy Policy, and the user agrees to the handling of user information by the Operator in accordance with this Privacy Policy. The Operator may, at its discretion, use and disclose information, data, etc. provided by users to the Operator as statistical information in a form that does not identify individuals, and users shall not object to this.

Article 14 (Modification of Terms of Use)

The Management Team may modify these Terms of Use at any time without notice to the user if it deems it necessary. When the Operator modifies the Terms of Use, the Operator shall notify the User of the modifications in a manner determined by the Operator. If the user uses the Service after notification of such changes, or if the user does not cancel his/her registration within the period specified by the Operator, the user shall be deemed to have agreed to the changes to these Terms without objection.

Article 15 (Notification or Communication)

Notification or communication between the user and the Management Team shall be made by the means prescribed by the Management Team.

Article 16 (Posting of Advertisements)

The user understands and agrees that the Service may include any and all advertisements, and that the Company or its partners may place any and all advertisements on the Service. The form and scope of advertisements on the Service may be changed by the Company at any time.

Article 17 (Assignment of Status under the Service Usage Agreement, etc.)

Users may not transfer their positions under the service use contract or their rights or obligations under these Terms of Use to a third party or offer them as collateral without the prior written consent of the Operator. In the event that the Operator transfers the business of the Service to another company, the Operator may transfer the user's position in the service contract, rights and obligations under these Terms of Use, and the user's registered items and other customer information to the transferee of such business transfer, and the user shall consent to such transfer as set forth in this paragraph. The User agrees to such transfer as set forth in this paragraph.

Article 18 (Governing Law and Jurisdiction)

This Agreement shall be governed by and construed in accordance with the laws of Japan. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the head office of the Management Team.
